Criminal Defense Q & A

I have been arrested for a felony offense.  What should I do?

The most crucial step to take after the arrest is to get legal representation from a Los Angeles felony defense lawyer.  You do not speak to law enforcement or give a statement or discuss the situation with any person involved without first getting legal representation from the Law Offices of Robert Schwartz to protect you.  A friendly law enforcement officer can use everything you say to make the situation even worse.  They are not your friends at this point.

I am suspected of a serious crime and am under investigation.  What should I do?

If you are being investigated for a homicide or other violent crime you can be quite certain that you will shortly be arrested.  It is crucial that you have legal representation from the moment you become aware that you are being investigated.  Don't answer questions until you have a skilled defense lawyer from the firm assisting you and advising you how to proceed.

Do I have to answer questions about a crime?

You need to answer the questions, but only after you have legal representation to support you.  Some questions the attorney may advise you that you are not required to answer.  Each case is individual and unique with a variety of circumstances and evidence.

How does bail work?

When you have been arrested and "booked" at the police station, this is the beginning of a complex process.  You may be released on your own recognizance.  In serious felony cases, there is usually a bail set by the judge.  It is important that you have an attorney representing you at any bail hearing, to attempt to get a bail amount that could be achieved so you can get out of jail while awaiting trial.  When the bail amount is set, you may have to use a "bail bondsman" that will require you to pay usually 10% of the bail amount and sign papers in order to be released.  Bail is set in order to ensure that you appear at trial.  Serious felony offenses such as murder usually have a bail amount of $1,000,000.  You need an attorney from the Law Offices of Robert Schwartz to assist you.
